Terms of Use

1. Acceptance of terms
By accessing or using the Officer Assist web and mobile application ("the App"), you ("the User") agree to be bound by these Terms of Use. If you are using the App on behalf of a Local Authority or corporate entity, you confirm that you have the authority to bind them to these terms.
2. Authorised use & eligibility
- Restricted Access: Officer Assist is strictly for use by authorised Environmental Health Officers, government officials and vetted security personnel.
- Account Security: you are responsible for maintaining the confidentiality of your login credentials. You must not share your account or allow unauthorised personnel to access the App.
3. Acceptable use and statutory duties
You agree to use the App solely for its intended professional purposes. When using the App to carry out statutory duties (e.g. enforcing health and safety, food hygiene or environmental protection laws), you agree to:
- Ensure all data, imagery and reports inputted are accurate to the best of your knowledge.
- Comply with your employer's internal policies and relevant regulatory frameworks (e.g. FSA Codes of Practice, Police and Criminal Evidence Act 1984 where applicable).
- Not use the App to process sensitive personal data outside the scope of your official duties.
4. Hardware and environmental readings (indicative use)
Officer Assist provides features such as GPS tracking and sound/decibel (dB) monitoring utilising the native hardware of your mobile device.
- Indicative Readings: you acknowledge that unless paired with a legally calibrated external device, any environmental readings (such as noise levels) captured via the device's native microphone are indicative only.
- Evidential Value: it is the User's responsibility to verify whether data captured purely via the App meets the evidential threshold for statutory nuisance prosecutions in a UK Court of Law.
5. Intellectual property
- Our Rights: we retain all intellectual property rights in the software, code, UI/UX design and underlying technology of Officer Assist.
- Your Data: your employer (the Local Authority or Agency) retains full ownership of all reports, data and media inputted into the App during the course of your duties.
6. Limitation of liability
To the maximum extent permitted by English law:
- Officer Assist is provided on an "as is" and "as available" basis.
- We shall not be liable for any indirect, consequential or special damages, including loss of data, loss of regulatory accreditation or compromised legal proceedings resulting from hardware failure, user error or network latency.
- Our total liability is governed by the Master Service Agreement (MSA) signed by your employer.
7. Freedom of Information (FOIA)
As our primary users are UK Local Authorities, we acknowledge that data held within Officer Assist may be subject to the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIR). We will assist your employer in complying with statutory disclosure requests where technically necessary.
8. Governing law
These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the English courts.
